I own an answering service and have lots of customers who are health care providers. Do I have to become compliant with all the HIPAA regulations?

If an answering service violates a Business Associate Contract, can the answering service be fined or punished by the authorities? And if so, which authorities?

Is it the responsibility of the answering service or the health care provider to provide the Business Associate Contract?

A patient calls their health care provider and receives the provider's answering service. The service records the patient's name, telephone number and symptoms and pages the health care provider. Does this answering service fall under the HIPAA regulations and are they a business associate?
